1. Educational Purpose Only

The content in this course (“the Program”) — including all videos, written materials, demonstrations, and downloadable resources — is provided for educational and informational purposes only.
It is not intended as a medical intervention , and does not replace consultation with a qualified healthcare professional.

2. Voluntary Participation & Assumption of Risk

By enrolling in or accessing this Program, you acknowledge that:

Participation is entirely voluntary.
The activities described may involve movement, stretching, sensory stimulation, or coordination tasks that carry a minimal inherent risk of discomfort or injury.
You are solely responsible for determining whether any activity is suitable for your child’s needs, abilities, and health status.
You voluntarily assume all risks, known or unknown, associated with participation in this Program.

3. Limitation of Liability

To the fullest extent permitted by Australian law, Brain and Body Health Pty Ltd, its directors, employees, contractors, and affiliates will not be liable for any injury, loss, or damage (physical, emotional, or financial) resulting from:

Participation in the Program;
Application or misapplication of information presented; or
Reliance on materials, demonstrations, or recommendations within the Program.

You agree that any claim or dispute will be limited to the amount paid for access to the Program, and no further damages or compensation will be sought.

4. Indemnity

You agree to indemnify and hold harmless Brain and Body Health Pty Ltd, its directors, officers, employees, and contractors against any and all claims, liabilities, damages, or expenses (including legal fees) arising from:

Your participation or your child’s participation in the Program;
Any reliance placed on the Program’s content; or
Any injury or outcome resulting from exercises performed based on this material.

5. No Therapeutic or Clinical Relationship

Participation in this Program does not establish a client–practitioner relationship.
The course is not a health service under AHPRA, NDIS, Medicare, or other clinical frameworks, and no diagnosis or personalised treatment plan is provided.

6. Intellectual Property

All Program materials, including text, video, audio, graphics, and downloadable content, remain the intellectual property of Brain and Body Health Pty Ltd.
These materials are licensed for personal, non-commercial use only and may not be reproduced, redistributed, or adapted without written permission.

7. Governing Law

This Agreement is governed by the laws of the State of New South Wales, Australia, and any disputes shall be resolved under the jurisdiction of the NSW courts.

8. Acceptance

By enrolling in the Program, or accessing course materials, you acknowledge that you have read, understood, and agreed to this Waiver, Disclaimer & Indemnity Agreement.
